As we shared with you a few weeks ago, DCFS did agree to extend the 3-hour rule to May 31, 2023.

On September 8, 2022, an updated Licensed Daycare Guidance was issued. This guidance reflects the extension of the 3-hour rule.

We often hear reports that there is a lack of communication from your reps for many programs in the state, so we wanted to make sure you had access to the most recent guidance.

Please make sure to download and save this guidance to reference as needed. We have heard from many directors about reps who are not aware of this rule or who have interpreted it differently.

The rule states “Centers may choose to staff classrooms with a qualified Early Childhood Assistant for up to 3 hours of their program day and should document such in the program’s Enhanced Staffing Plan.”

There is no mention of time of day this can be used or what classrooms this can be used in. If your rep has a different interpretation, please reach out to us, so we can share this information with DCFS.
